1. Acceptance of Terms

By accessing or using PartyPerfect Pro ("Service") operated by BerryWorks 3D LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PartyPerfect Pro is a business management application designed for direct sales consultants. The Service includes contact management, party booking, SMS messaging, goal tracking, team management, and related features.

3. User Accounts

To use the Service, you must:

  • Create an account with accurate information
  • Be at least 18 years of age
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use

4. Subscription, Cancellation & Refunds

Free Trial

We offer a 30-day free trial so you can fully evaluate the Service before making any payment commitment. This trial period is designed to ensure the Service meets your needs before you subscribe.

Subscription Terms

  • The Service is offered on a subscription basis
  • Subscriptions renew automatically each billing cycle unless canceled
  • You will be charged on the same day each billing period

Cancellation

  • You may cancel your subscription at any time through Settings > Billing
  • Upon cancellation, you retain full access until the end of your current billing period
  • No action is required after cancellation; your subscription will not renew

Refund Policy

  • All subscription payments are final and non-refundable
  • Because we provide a generous free trial period, we do not offer refunds for subscription payments
  • We encourage all users to fully evaluate the Service during the trial before subscribing
  • SMS credits are non-refundable, non-transferable, and expire when your subscription ends

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited messages, or harassing communications
  • Violate any applicable laws including TCPA and CAN-SPAM
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to other accounts
  • Use the Service to compete with us

6. SMS Messaging Compliance & Financial Liability

You are solely responsible for obtaining proper consent before sending SMS messages through the Service. You must comply with all applicable laws including the Telephone Consumer Protection Act (TCPA).

Financial Responsibility: You acknowledge and agree that you are fully responsible for any carrier fines, fees, or penalties resulting from your messaging behavior. Carrier fines can range from $500 to $2,000+ per violation and will be charged to your payment method on file. See our SMS Terms for detailed messaging policies and prohibited activities.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by BerryWorks 3D LLC and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, BerryWorks 3D LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

Exclusions: The limitation of liability set forth above does not apply to your financial obligations for carrier fines, fees, or penalties resulting from your SMS messaging behavior. You accept full financial responsibility for any such charges as described in our SMS Terms.

9. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
